LVRS Terms of Service

1. Overview

This website is operated by LVRS the Label (referred to as “LVRS”, “we”, “us” or “our”). Throughout these Terms of Service, “you” and “your” refer to anyone who visits our website, creates an account or purchases from us.

Our website, online store and related content, features, products and services are collectively referred to as the “Services”. Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer our products to you.

By accessing or using our Services, you agree to these Terms of Service and any policies referred to in them, including our Privacy Policy, Returns Policy and Shipping Policy. If you do not agree, please do not use the Services.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

2. Eligibility and accounts

You must be legally capable of entering into a binding agreement to place an order. If you are under 18, you should use the Services only with the involvement and permission of a parent or guardian.

You agree to provide accurate, current and complete information when using our Services or placing an order. If you create an account, you are responsible for keeping your login details secure and for activity conducted through your account. Please notify us promptly if you believe your account has been accessed without permission.

We may suspend or close an account where we reasonably believe it has been used fraudulently, unlawfully or in breach of these Terms.

3. Products

We make reasonable efforts to display and describe our products accurately. Colours and appearance may vary slightly depending on your device, screen settings, lighting and photography. Product measurements are approximate, and minor variations may occur.

Product availability is not guaranteed. We may change or discontinue products and may reasonably limit quantities available to a person, household, region or order.

Our products come with guarantees that cannot be excluded under the Australian Consumer Law, including that they will be of acceptable quality, match their description and be fit for any disclosed purpose where applicable.

4. Orders

Submitting an order is an offer to purchase products from us. An order is accepted when we send you confirmation that it has been accepted or dispatched. An automated order acknowledgement does not necessarily mean that we have accepted the order.

We may reject or cancel an order where reasonably necessary, including where:

• a product is unavailable;

• there is an obvious pricing or product-information error;

• payment cannot be authorised;

• we reasonably suspect fraud, unauthorised resale or misuse of a promotion; or

• we cannot deliver to the address provided.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled item or order to the original payment method.

Please check your order and delivery details carefully before submitting it. Contact us as soon as possible if you need to request a change or cancellation. We cannot guarantee changes once an order has entered processing or been dispatched.

Products purchased through our store are intended for personal use and not for unauthorised commercial resale.

5. Prices, payments and promotions

All prices are shown in Australian dollars (AUD). Prices include GST where applicable unless stated otherwise. Delivery charges, if any, will be displayed at checkout before you complete your purchase.

We may change prices at any time, but changes will not affect orders already accepted, except where there is an obvious error. You agree to provide accurate billing and payment information and confirm that you are authorised to use the selected payment method.

Discounts, promotional codes and offers may be subject to separate conditions, expiry dates and exclusions. Unless stated otherwise, promotions cannot be combined. We may cancel or refuse a discount where we reasonably believe it has been used fraudulently or contrary to its stated conditions.

6. Shipping and delivery

Shipping options, charges and estimated delivery times are set out in our Shipping Policy and at checkout.

Delivery estimates are not guaranteed. Delays may occur due to carriers, weather, peak periods or other circumstances outside our reasonable control. We will take reasonable steps to assist with delayed, missing or damaged deliveries.

You are responsible for providing a complete and accurate delivery address. Additional costs caused by an incorrect or incomplete address may be charged to you where permitted by law.

Nothing in this section limits any rights you may have under the Australian Consumer Law.

7. Returns, refunds and consumer guarantees

Change-of-mind returns are handled in accordance with our Returns Policy.

Our Returns Policy is in addition to your rights under the Australian Consumer Law. If a product is faulty, unsafe, does not match its description or otherwise fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy depending on the circumstances.

8. Intellectual property

Unless otherwise stated, the website and its content—including the LVRS name and logos, product names, text, photographs, videos, graphics, designs and website layout—are owned by or licensed to LVRS and are protected by applicable intellectual-property laws.

You may access and use the Services for personal, non-commercial purposes. You must not copy, reproduce, republish, distribute, modify, sell, exploit or create derivative works from our content without our prior written permission, except where permitted by law.

Third-party names, logos and trademarks displayed through the Services remain the property of their respective owners.

9. Reviews and other content you submit

If you submit a review, photograph, comment, suggestion or other content to us (“User Content”), you confirm that you own it or have permission to submit it and that it does not violate any law or another person’s rights.

You grant LVRS a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit, publish and display that User Content for operating, improving and promoting LVRS and our Services. This licence does not transfer ownership of your User Content to us.

You must disclose any payment, free product or other incentive received in connection with a review. We may remove User Content that we reasonably consider unlawful, misleading, offensive, infringing or otherwise inappropriate.

10. Acceptable use

You must not use the Services to:

• break any law or infringe another person’s rights;

• submit false, misleading, abusive or unlawful content;

• introduce viruses, malicious code or other harmful technology;

• attempt to gain unauthorised access to the website, accounts or connected systems;

• interfere with the security, availability or operation of the Services;

• collect personal information about others without authority;

• send spam or unauthorised promotions; or

• scrape, copy or commercially exploit the Services or their content without permission.

We may restrict or suspend access where reasonably necessary to protect LVRS, our customers, third parties or the security of the Services.

11. Third-party services and links

The Services may contain links to or features provided by third parties, including payment providers, social-media platforms and delivery services. Third-party services are governed by their own terms and privacy policies.

We are not responsible for third-party websites or services that we do not control. You should review their terms and policies before using them or making a purchase from them.

12. Shopify

Our store is hosted by Shopify. Purchases made through our store are transactions between you and LVRS, not Shopify. Shopify is not the seller of our products and is not responsible for fulfilling your order or providing remedies relating to products purchased from LVRS.

Certain personal information may be processed by Shopify to provide and improve the ecommerce services used by our store. Further information is available in our Privacy Policy and Shopify’s Consumer Privacy Policy.

13. Privacy

We handle personal information in accordance with our Privacy Policy. By using the Services, you acknowledge that information may be processed by Shopify and other service providers that help us operate our website, process payments, fulfil orders and communicate with customers.

14. Website availability and information

We aim to keep the Services accurate, secure and available, but we do not guarantee that access will always be uninterrupted or error-free. We may temporarily suspend or change parts of the Services for maintenance, security or operational reasons.

We may correct typographical errors, inaccuracies or omissions in product descriptions, prices, promotions, delivery charges, transit times or availability. If an error affects an order you have placed, we will contact you where reasonably practicable and provide any remedy required by law.

General content on our website is provided for information only and should not be relied on as professional advice.

15. Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

To the extent permitted by law, LVRS is not liable for indirect or consequential loss arising from your use of the Services where that loss was not reasonably foreseeable. We are not responsible for loss caused by your misuse of a product, failure to follow care instructions, unauthorised access to your account caused by your failure to protect your login details, or events outside our reasonable control.

Any limitation in these Terms applies only to the maximum extent permitted by law.

16. Indemnity

To the extent permitted by law, you agree to compensate LVRS for reasonable loss, damage or expense arising directly from your unlawful use of the Services, your material breach of these Terms or your infringement of another person’s rights. This does not apply to the extent that the loss was caused or contributed to by LVRS.

17. Ending access

You may stop using the Services at any time. We may suspend or terminate your access where we reasonably believe you have materially breached these Terms, used the Services unlawfully or created a security risk.

Ending access does not affect rights or obligations that arose before termination. Provisions that are intended by their nature to continue—including intellectual-property, liability and governing-law provisions—will remain in effect.

18. Severability and waiver

If any part of these Terms is found to be invalid or unenforceable, it will be read down or severed to the minimum extent necessary, and the remaining provisions will continue to apply.

If we do not enforce a provision immediately, that does not mean we waive our right to enforce it later.

19. Changes to these Terms

We may update these Terms from time to time by publishing the revised version on this page and changing the “Last updated” date. Where required by law, we will provide reasonable notice of material changes.

Changes will apply from the stated effective date and will not retrospectively alter an order already accepted unless required by law or agreed with you.

20. Governing law

These Terms are governed by the laws of Victoria, Australia. You and LVRS submit to the non-exclusive jurisdiction of the courts of Victoria and courts entitled to hear appeals from them.

Nothing in this section limits any rights you may have to bring a claim in another jurisdiction under applicable consumer law.
